Labor and Employment

For more than thirty years, our attorneys have represented both private and public sector labor unions in the following industries and professions: hotel and hospitality, restaurant, bakery, sports entertainment, health care, commercial moving, warehouse and trucking, garage and parking, construction, heavy construction, road building and paving, carpentry, electrical, plumbing, facilities management, engineering and maintenance, airline and electrical parts manufacturing, wholesale and retail food sales and distribution, sanitation, education, law enforcement and fire safety.

Pitta & Giblin LLP counsels and represents labor unions in all labor and management relations matters,  including collective bargaining negotiations, grievance mediation and arbitration proceedings, National Labor Relations Board election cases and unfair labor practice proceedings, New York State Public Employment Relations Board improper practices proceedings, New York City Office of Labor Relations and Office of Collective Bargaining proceedings and New York City Comptroller prevailing wage investigations and proceedings, all State of New Jersey Department of Labor and Workforce Development matters and in all New York and New Jersey related federal and state court litigations.

We counsel labor unions and have successfully defended them in federal and state court litigation and government agency proceedings including but not limited to fair representation and employment matters, alleged secondary boycott activity, defamation and other torts and claims, including those brought under the Racketeer Influenced and Corrupt Organizations Act (RICO).

Internal Union Disciplinary Issues, Officer Elections and Governance Matters

We regularly advise clients in connection with internal union disciplinary matters brought under their own and any parent union constitution and bylaws.  We provide expert advice to our clients in connection with union officer nomination and election procedures, including the defense against individual or government challenge to such nomination and election procedures and the results thereof.  We routinely counsel and advise labor unions regarding their obligations under the Labor-Management Reporting and Disclosure Act (LMRDA) and in all governance matters including union democracy and ethical practices issues and the interpretation and drafting of constitutions and bylaws.

Government Audits and Investigations, Trusteeship Issues and Internal Union Investigations

We are expert in representing labor unions in connection with government audits and investigations.  We have extensive experience in representing both local and parent unions in union-imposed trusteeships/supervisions as well as in government or court-imposed monitorships, and in connection with agreements with independent private sector inspectors general.  We are regularly called upon to conduct internal union investigations for our clients to detect and remediate dishonesty, fraud and corruption, as well as to investigate complaints of workplace discrimination, violence or harassment.

Employment Law Practice

Pitta & Giblin LLP advises and assists labor unions in their compliance with all federal, state and local labor and employment laws, including drafting employee handbooks and employment policies for their own employees and in conducting internal investigations into complaints of harassment and discrimination of any kind.  We regularly represent our labor union clients before the U.S. Equal Employment Opportunity Commission, New York State Division of Human Rights, New York City Commission on Human Rights and State of New Jersey Department of Labor and Workforce Development, and in all New York and New Jersey related federal and state court litigations.

Employee Benefits Law Practice

Our attorneys counsel and advise labor union designated trustees of both joint union and employer sponsored Taft-Hartley multi-employer, and single employer, employee benefit funds, with respect to their obligations under the Employee Retirement Income Security Act (ERISA), the Consolidated Omnibus Budget Reconciliation Act (COBRA), the Family and Medical Leave Act (FMLA) and the Health Insurance Portability and Accountability Act (HIPAA) and in connection with all IRS, and U.S. Department of Labor rules and regulations.

We are expert in plan drafting as well as in the negotiation, drafting, administration and enforcement of third party service provider agreements.  We have extensive experience in representing clients in connection with government audits and investigations and in the defense of government prosecuted litigations relating thereto.
